Buyback Terms and conditions

Definitions
1.1 "Buyback Order" means the order submitted by the Trader to exchange his/her game currency through OffGamers;

1.2 "Offers" means the price stated for the game currencies and/or items available during and/or after submission of the Buyback Order;

1.3 "OffGamers" means OffGamers Limited, Room 813, Hollywood Plaza, 610 Nathan Road, Kowloon, Hong Kong SAR;

1.4 "Services" means all services and/or performance of works or professional services that OffGamers agrees to trade with the Trader, as set out in the Buyback Order;

1.5 "Terms and Conditions" means these terms and conditions and any special terms and conditions agreed in writing by OffGamers and set out in the Buyback Order;

1.6 "Trade" means the act of initiating the transfer of game currencies and/or items as set out in the Buyback Order;

1.7 "Trader" means the person or organization who submits a Buyback Order for for any game to OffGamers.

Terms and Conditions
2.1 OffGamers Services are subjected to these Terms and Conditions with exclusion of any other terms and conditions, stipulated or referred to by the Trader.

2.2 The Trader acknowledges that he/she is aware of the contents and agrees to be bound by these Terms and Conditions.

2.3 Any variation to these Terms and Conditions (including any special terms and conditions agreed between the parties) shall be inapplicable unless agreed in writing by OffGamers. The Buyback Order, these Terms and Conditions and any special terms and conditions shall form the entire agreement between OffGamers and the Trader in relation to the Services rendered.

Offers and Payment for Buyback Orders
3.1 Unless otherwise agreed, the Offers are:

3.1.1 that stated in the Buyback Order;
3.1.2 on real time basis, wholly based on current stock movements of OffGamers and as well as the latest market prices;
3.1.3 automatically cancelled if the Trader is unable to be reached after 5 minutes from the appointed Delivery Time;
3.1.4 fixed upon submission of Buyback Order; and
3.1.5 in the currency agreed between OffGamers and the Trader, and if no currency has been agreed, in US Dollars.

3.2 Traders can choose the following payments methods to receive payments for their Buyback Orders:

3.2.1 OffGamers Store Voucher (in USD)
3.2.2 e-gold (in USD)
3.2.3 PayPal (in USD)
3.2.4 Moneybookers (in USD)
3.2.5 Alipay 支付宝 (in RMB)
3.2.6 ICBC 中国工商银行 (in RMB)
3.2.7 Wire Transfer (in USD)
3.2.8 Western Union (in USD)
3.2.9 PayPal Mass Payment (in USD)
3.2.10 WebMoney (in USD)
3.2.11 Direct Deposit/EFT (in MYR)

3.3 To receive payments, Traders are required to select any one of the payment methods stated above provided with valid and correct billing information when creating the Payment Account.

3.4 OffGamers will not be liable for any claims, demands, cause of action, damage, loss, consequential loss, costs, expenses arising from invalid payment information provided.

3.5 OffGamers will make payments for 'Completed' Buyback Orders from Monday to Friday between 1000 – 1800 GMT +8. All Buyback Orders completed outside these hours will be processed and paid out the next working day.

3.6 Payment will be made once the Trader meets either of the following conditions:

Condition A

• Trader must provide, a valid telephone number and screenshots of the trade and confirmation of trade with customer. OffGamers will contact the customer to confirm that the trade was successful.

• Screen shots submitted must be in compliance with the guidelines set by OffGamers.

• If the screen shots submitted are not in compliance with our guidelines, payments may be delayed for up to 7 business days for OffGamers to evaluate the Buyback Order.

Condition B

• If no screenshot have been taken for any reason, we will require 7 business days to evaluate the Buyback Order before making payment.

3.7 Once any of the conditions are fulfilled payment will be immediate or within 7days.

3.8 OffGamers reserves the right to suspend payment or to dissolve the agreement without intervention of the courts if an order is suspected to be placed with the purpose of intentional misconduct.

Delivery and Transfer
4.1 The Trader is to ensure that all information during submission of the Buyback order is correct and valid, including the game name, server name, character name, amount of game currency to be traded, and contact information.

4.2 OffGamers will not be liable for any claims, demands, cause of action, damage, loss, consequential loss, costs, expenses arising from invalid information provided.

4.3 Delivery and Transfer of game currencies and/or items are to be traded via 'Face to Face' Method in game and no exceptions will be accepted unless otherwise stated and agreed in writing by OffGamers.

4.4 All Buyback Orders are treated on a 'first come first serve' basis. Should the Trader fail to show up in game at the arrange time of Trade, and another Trader has accepted the Offer, OffGamers reserves all the rights to cancel, without notice the whole or any part of the Buyback Order and attend to the other Trader.

4.5 Should OffGamers be not able to reach the Trader in-game and by phone, after 5 minutes from the appointed Delivery Time, the Buyback Order will be cancelled immediately and a new order will have to be submitted again by the Trader.

Usage of Bots, Third Party Software and Illegal Macros
5.1 OffGamers does not support and objects to the usage of bots, third party software and/or illegal macros in game.

5.2 The Trade of duplicated, macroed, copied or any kind of mass-produced or fast-produced items and/or outside programs is prohibited. If such programs are used, OffGamers has the rights to report these devices to the proper authorities.

5.3 If the product is duplicated, macroed or copied, OffGamers reserves the right to delete the product, and issue no payment or Trade to the seller. It is illegal to sell these materials and OffGamers will not under any circumstances be involved or related to such materials.

Title and Risk
6.1 The title and risk in the Services shall remain with the Supplier until they are delivered at the point specified by OffGamers in the Buyback Order or any other relevant document, and transferred to OffGamers’ possession, at which time title and risk in the Services shall transfer to OffGamers.

Liability & Indemnification
7.1 The Trader acknowledges that OffGamers reserves the rights at anytime to modify or discontinue the Service (or any part thereof) with or without notice, and that OffGamers will not be liable to you or to any third party for any modification, suspension, or discontinuance of the Service.

7.2 Use of the Service is at the Trader's own risk, The Service is provided on an "as is" and "as available" basis without any warranty or condition, expressed, implied or statutory.
